Terms and conditions

Terms and Conditions for After-School Educational Services These Terms and Conditions apply to all after-school educational activities, workshops, courses and related services provided by Smart Health and Science at Denise school. By registering a child for a course or activity, the parent/legal guardian confirms that they have read, understood and accepted these Terms and Conditions.

  1. Provider The services are provided by: Smart Health and Science Email: office@smarthealthandscience.nl Phone/WhatsApp: 06-29601452 Website: https://smarthealthandscience.nl
  2. Services Smart Health and Science provides educational activities for children, including but not limited to robotics, coding, digital literacy, creative technology, science, engineering, dance around the world and related learning programs. The exact course content, age group, schedule, duration, price and location will be communicated during the registration.
  3. Registration and Confirmation Registration is subject to availability. A child’s place in the course is confirmed only after registration has been accepted and payment has been received. Smart Health and Science may refuse or cancel a registration if the course is full, if the child does not meet the age or participation requirements, or if payment has not been received on time.
  4. Payment The course fee must be paid according to the payment instructions provided at the time of registration. Unless agreed otherwise in writing, payment must be completed before the start of the course. Failure to pay on time may result in the child’s place being offered to another participant.
  5. Cancellation by Parents or Legal Guardians After registration has been confirmed, cancellations by parents or legal guardians are not eligible for refund. Missed lessons, absence, illness, holidays, scheduling conflicts or other personal circumstances do not entitle the parent/legal guardian to a refund, credit or replacement lesson. No returns, partial refunds or proportional reimbursements are provided for non-attendance. Mandatory statutory consumer rights, where applicable, remain unaffected.
  6. Cancellation or Interruption by the School If a lesson or course cannot take place due to circumstances caused by or related to the school, including but not limited to room unavailability, school closure, scheduling changes, access restrictions or school-organised events, Smart Health and Science will not provide a monetary refund. Where reasonably possible, Smart Health and Science may offer an alternative lesson, replacement activity or another practical solution. If this is not possible, the cancelled lesson may be compensated in the form of a discount for a following course period. No reimbursement will be made for the ongoing course period.
  7. Cancellation by Smart Health and Science If Smart Health and Science cancels a lesson due to illness of the teacher, operational reasons or other circumstances within its control, Smart Health and Science will aim to offer a replacement lesson where reasonably possible. If a replacement lesson cannot reasonably be offered, the cancelled lesson will be compensated in the form of a discount for the following course period. No monetary reimbursement will be made for the ongoing course period.
  8. Changes to Schedule, Teacher or Program Smart Health and Science may make reasonable changes to the course schedule, teacher, classroom, lesson format or course content when necessary. Such changes do not entitle the parent/legal guardian to a refund, provided that the general nature and educational purpose of the course remain substantially the same.
  9. Minimum and Maximum Number of Participants Courses may be subject to a minimum and maximum number of participants. If the minimum number of participants is not reached, Smart Health and Science may cancel or postpone the course. In that case, parents/legal guardians will be informed as soon as reasonably possible and may be offered an alternative course, later starting date, credit or refund at the discretion of Smart Health and Science.
  10. Child Participation and Behaviour Children are expected to participate respectfully and safely. Smart Health and Science may remove a child from a lesson or course if the child’s behaviour is unsafe, disruptive, aggressive or prevents other children from participating. In such cases, no refund will be provided. Parents/legal guardians remain responsible for informing Smart Health and Science of any relevant medical, behavioural, learning or support needs that may affect the child’s participation.
  11. Safety and Responsibility Smart Health and Science will take reasonable care to provide a safe and appropriate learning environment during the activity. Parents/legal guardians remain responsible for ensuring that the child arrives on time and is collected on time, unless different arrangements have been agreed with the school. Smart Health and Science is not responsible for loss of or damage to personal belongings brought by the child.
  12. Materials and Equipment Where materials or equipment are provided by Smart Health and Science, they must be used carefully and only for the intended educational purpose. Parents/legal guardians may be charged for intentional or negligent damage to materials, tools, robots, computers or other equipment.
  13. Photos and Marketing Photos or videos of children will only be used for marketing or communication purposes where permission has been obtained from the parent/legal guardian or where such use has been arranged through the school’s existing consent procedures.
  14. Personal Data Smart Health and Science processes personal data only where necessary for registration, communication, administration, safety and delivery of the course. Personal data may include the child’s name, age, group/class, parent/legal guardian contact details and relevant participation information. Personal data will not be sold to third parties.
  15. Liability Smart Health and Science is liable only for direct damage caused by intent or gross negligence. Smart Health and Science is not liable for indirect damage, consequential loss, missed opportunities, emotional distress, or damage resulting from incorrect or incomplete information provided by parents/legal guardians. Nothing in these Terms and Conditions excludes liability where such exclusion is not permitted by law.
  16. Force Majeure Smart Health and Science is not liable for cancellation, delay or non-performance caused by circumstances beyond its reasonable control, including but not limited to illness, government measures, school closure, weather conditions, transport disruption, technical failure, strikes, emergencies or other force majeure events. In such cases, Smart Health and Science may offer a replacement lesson, alternative arrangement or discount for a following course period, depending on the circumstances.
  17. Complaints Any complaint should be submitted in writing by email to office@smarthealthandscience.nl within 7 days after the relevant lesson or event. Smart Health and Science will review the complaint and respond within a reasonable period.
  18. Governing Law These Terms and Conditions are governed by the laws of the Netherlands. Any disputes will first be addressed through reasonable consultation. If no solution is reached, the dispute may be submitted to the competent court in the Netherlands.
